Terms of Use
TERMS OF USE
1.1 Scope and Operator
These Terms of Use apply to the use of the online portal www.tripto.se and the intermediation services offered through it. The operator of the portal is the Swedish stock corporation TripTo AB, Storgatan 63, 385 40 Bergkvara, Sweden (Corporate ID 556666-0741), hereinafter referred to as "Tripto". These Terms of Use govern the use of the portal and the general conditions of Tripto's intermediation activities. For the respective holiday accommodation, the booking and rental terms of the respective landlord displayed in the booking offer shall additionally apply.
1.2 Intermediation and Contractual Relations
Tripto operates an online portal for the intermediation of holiday accommodations, particularly in Sweden. Tripto intermediates bookings between guests and the respective owners or landlords of the accommodations. The rental agreement for the holiday accommodation is concluded directly between the guest and the respective landlord. Tripto provides the intermediation and booking services described in the booking process and may accept payments on behalf of the landlord and settle them with the landlord.
The specific landlord and the conditions applicable to the respective booking will be communicated to the guest during the booking process and in the booking confirmation. Mandatory statutory information obligations, particularly towards consumers, remain unaffected. The responsibility of the landlord for the performance of the rental contract as well as Tripto's own statutory responsibility for the intermediation services and other own duties remain unaffected.
1.3 Eligibility for Use
Bookings through the portal may only be made by persons who have completed their 18th year of age and are legally authorized to conclude the respective contract. Users are obligated to provide complete and truthful information requested during an inquiry or booking. Any changes to relevant information must be communicated to Tripto or the landlord immediately.
1.4 Payment Processing
The prices, payment deadlines, payment methods, and any additional costs applicable to a booking are specified in the respective booking offer or in the associated booking conditions. To the extent that Tripto accepts payments on behalf of the landlord, this is done within the scope of the agreed payment processing. Tripto settles the received amounts in accordance with the provisions agreed upon with the landlord.
Payment is deemed to have been made as soon as it has been received in accordance with the payment terms applicable to the booking. The confirmation of a payment or booking is subject to the procedure described in the booking process. For cancellations, refunds, and other refund claims, the conditions agreed for the respective booking as well as the applicable statutory provisions shall apply.
1.5 Property Descriptions and Customer Reviews
The information regarding the accommodations, including equipment, location, availability, prices, and images, is partly based on information provided by the respective landlords. Tripto endeavors to provide a careful and up-to-date presentation of the information. Tripto cannot guarantee that all information provided by landlords is complete, error-free, and up-to-date at all times. This does not limit any statutory claims to which guests are entitled against Tripto or the landlord. If Tripto becomes aware of material errors, Tripto will review them within the scope of its possibilities and take appropriate measures.
To the extent that customer reviews (e.g., via widgets from Google or Trustpilot) are displayed on the portal, this constitutes user-generated content from third parties. Tripto does not adopt these reviews as its own. Tripto assumes no warranty for the correctness, completeness, or legality of these reports written by third parties, unless Tripto demonstrably gains knowledge of illegal content and fails to delete it immediately.
1.6 Liability
Tripto is liable in accordance with the applicable statutory provisions for damages caused by intentional or negligent conduct of Tripto, its legal representatives, or vicarious agents, to the extent that liability cannot be effectively excluded or limited by law. In the event of slightly negligent breaches of duty, liability is limited, to the extent permitted by law, to the breach of essential contractual obligations. In this case, liability is limited to the foreseeable, contract-typical damage at the time the contract was concluded.
The objective limitations do not apply to the extent that liability may not be excluded or limited by law, particularly in the case of damages resulting from injury to life, body, or health, as well as in the case of intentional conduct. The respective landlord is generally responsible for the performance of the rental contract. Tripto's own statutory responsibility for the intermediation service and other own duties remain unaffected. Tripto endeavors to ensure reliable operation of the portal but cannot guarantee uninterrupted and error-free availability due to technical reasons. Statutory claims due to a breach of duty for which Tripto is responsible remain unaffected.
1.7 Governing Law
Swedish law shall apply, to the extent that this choice of law is permissible. If the user is a consumer and has their habitual residence in another state, the mandatory consumer protection provisions shall remain unaffected which the consumer is entitled to under the law applicable without a choice of law.
1.8 Dispute Resolution
Tripto is not obligated and, to the extent permitted by law, not willing to participate in dispute resolution proceedings before a consumer arbitration board. Mandatory statutory rights of the consumer, particularly the right to seek legal remedy in court, remain unaffected.
1.9 Miscellaneous Provisions
If individual provisions of these Terms of Use should be or become invalid in whole or in part, the remaining provisions shall remain effective to the extent permitted by law. The invalid provision shall be replaced by the applicable statutory provisions.
